Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of DataPhantom (“Service”), including our Chrome browser extension, website, application programming interfaces (APIs), and any related tools or features. By installing the extension, creating an account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

DataPhantom is a browser-based web scraping tool with AI-assisted capabilities. It allows you to select and extract data from web pages you visit and export that data in formats such as JSON or CSV. The Service is designed for individuals and small businesses and is offered with a free trial and optional paid subscription plans (e.g. monthly or annual). Features, pricing, and availability may change over time. We do not guarantee that every website will be scrapeable or that AI features will be available in all regions.

3. Browser Extension and Permissions

Our Chrome extension requires certain permissions to function (e.g. access to pages you choose to scrape, storage, and optional identity for sign-in). You grant these permissions when you install or use the extension. The extension only accesses page content when you actively use it on a tab; we do not continuously read or transmit the full content of every page you visit. You may revoke access by uninstalling the extension or disabling it for specific sites via your browser.

4. AI Features

Where we offer AI-powered features (e.g. smart selection, extraction assistance), those features may send limited data (such as selected page content or structure) to our systems or third-party AI providers to process and return results. By using AI features, you agree to that processing. Output from AI is provided for convenience only; you are responsible for verifying accuracy and compliance with these Terms and applicable law.

5. Acceptable Use

You agree to use the Service only in compliance with applicable laws and in a manner that does not:

  • Violate the terms of service, robots.txt, or other policies of the websites you scrape
  • Infringe intellectual property, privacy, or other rights of others
  • Overload or harm our systems, third-party services, or target websites (e.g. excessive requests, denial-of-service behaviour)
  • Use the Service for illegal, fraudulent, or deceptive purposes
  • Scrape or collect personal data in a way that violates privacy or data protection laws

You are solely responsible for ensuring that your use of the Service and any scraped data complies with the law and the terms of the sources you scrape. We do not guarantee that scraping any particular site is lawful in your jurisdiction. We may suspend or terminate access if we reasonably believe you have violated these Terms or applicable law.

6. Account and Subscription

You may sign in via Google or email/password. You must provide accurate information and keep your account secure. Subscription fees (e.g. monthly or yearly) are as displayed at sign-up. Fees may be processed by our payment provider (e.g. Stripe). Refunds are subject to our refund policy and applicable law. We may change pricing with reasonable notice; continued use after changes constitutes acceptance. Credits or usage limits may apply as described in the Service or your plan.

7. Intellectual Property

DataPhantom and its branding, software, and materials are owned by us or our licensors. We grant you a limited, non-exclusive, revocable licence to use the Service for your personal or internal business use in accordance with these Terms. You do not acquire ownership of our software or branding. Data you scrape and export remains yours, subject to your compliance with these Terms and the law. You do not receive any rights to the underlying source code or our AI models.

8. Disclaimers

The Service is provided “as is” and “as available”. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that scraped or AI-generated data will be accurate or complete. Use of the Service and any scraped or generated data is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, we (and our affiliates, directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use or inability to use the Service. Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months before the claim.

10. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any law or third-party rights, or your use or distribution of scraped data.

11. Termination

We may suspend or terminate your access to the Service at any time for breach of these Terms or for any other reason. You may stop using the Service at any time (e.g. by uninstalling the extension and closing your account). On termination, your right to use the Service ceases. Sections that by their nature should survive (e.g. disclaimers, limitation of liability, indemnity) will survive.

12. Changes

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.

13. General

These Terms constitute the entire agreement between you and us regarding the Service. If any part is held invalid, the rest remains in effect. Our failure to enforce any right does not waive that right. These Terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of the courts of Australia.
